Downer EDI ordered to reinstate workers at Boggabri Coal Mine

It is reported that the mining union has won an unfair dismissal claim against mining contractors Downer EDI, for three workers who lost their jobs at the Boggabri Coal Mine last year.

The Fair Work Commission has ordered that all three workers be reinstated, and ordered Downer EDI to back pay the men for lost wages.

Mr Peter Jordan, CFMEU District President, said that the redundancies validate the Union's argument the workers should never have been sacked.

Mr Jordan said that "This decision is a kick in the guts to Downer, because everything that was said to them, they ignored."

he said that "They were arrogant and steadfast throughout the entire process, refused to negotiate, refused to consider about reaching some compromise arrangement and now they're confronted with a decision that was all in favour of the workers."

He added that he hopes the decision makes Downer reconsider what he says is a practice of hiring 457 workers over locals.

He further added that "They've made applications on a number of occasions to bring 457 Visa workers into Australian mining jobs."
