HC Notice to MSMC over Fixed Coal Washery Tender - Report

TOI reported that Maharashtra State Mining Corporation’s criteria for selecting a washery to wash coal and supply it to Mahagenco has run into trouble. A coal washery operator has moved Nagpur bench of Bombay high court, alleging that the tender was tweaked to favour two handpicked companies. The petitioner, Bhatia Coal Limited, in its petition before HC questioned the very rationale behind prescribing turnover of INR 85 to INR 140 crore for ‘A’ category work, and between INR 240 to INR 400 crore for ‘B’ category. It alleged that this was done to prevent competition from all eligible operators from Vidarbha region. A division bench of justice Ravi Deshpande and justice Vinay Joshi while issuing notice to MSMC and two participating bidders M/s SICAL Logistics and Hind Energy directed them to file reply by September 11. The HC permitted MSMC to open the technical bids but restrained them from opening the financial bids.

MSMC had invited tender on August 16, 2019, for washing coal and supplying it to Chandrapur, Koradi, Khaparkheda, Nashik, Bhusawal, Parali and Paras thermal power stations of Mahagenco for next five years. The successful bidder has to lift 22 million metric tonne coal per annum from Western Coalfields Limited, Mahanadi Coalfields Ltd and South Eastern Coalfields Ltd mines and wash the raw coal at the washery plant.
